NCAM Director, Sajida Salman, emphasized, “While combating hate speech is essential, this bill overlooks the intersection of race and religion, leaving Muslim communities vulnerable to discrimination. A more comprehensive approach that explicitly addresses religious hatred is vital to ensure the safety and dignity of all Australians.” The bill’s failure to include religious protections fails to shield Muslims and other faith-based communities from growing incidents of Islamophobia, evidenced by recent attacks on Muslim women and rising anti-Muslim rhetoric.
In addition to expressing concern over the bill, NCAM aligns with other community organizations advocating for more equitable and civil measures to address hate speech. NCAM believes that civil penalties, rather than criminalizing speech, would provide a more balanced approach to tackling hate without infringing on the right to free expression. Furthermore, NCAM supports strengthening existing online safety laws to combat dehumanizing speech, particularly on social media platforms, which can amplify hate and incite violence.
NCAM urges the NSW government to engage in meaningful consultations with affected communities to revise the bill and ensure that it addresses all forms of hate, including religious discrimination. “We need legislation that not only addresses racial hatred but also recognizes the unique challenges faced by religious communities,” concluded Sajida. “It is essential that we build a society where all citizens, regardless of faith, can live free from fear of hate and discrimination.”
